The purpose of this article is to analyze if there is still a general paradigm of civil contract law that differs from the one regulating contracts in commercial law.The author believes that such a paradigm, if it still exists, was already deeply eroded during the drafting of the 1942 Civil Code, is very residual in terms of practical application and is destined to disappear forever under the pressure of supranational influences.
L'articolo affronta la questione relativa al se esista ancora un diritto civile patrimoniale che regola lo scambio secondo un paradigma diverso rispetto a quello che regola lo scambio nel settore del diritto commerciale.Si ritiene che tale diritto, ammesso che ancora si possa considerare esistente, sia stato già profondamente eroso in sede di redazione del codice del 1942, sia decisamente residuale sotto il profilo della concreta applicazione e sia destinato a scomparire definitivamente sotto la spinta di influenze sovranazionali.
