Abstract: The judgment Loyola v. Canada sees protagonist a confessional school who refuses to submit to the neutral government educational program, advancing pretension of guardianship of her own religious liberty as group and her liberty to teach from a religious and not neutral perspective. The examined case also allows to develop some reflections about the peculiarities of the Canadian constitutional system, and the relationship between the public institutions and the religious phenomenon, in a contest of strong pluralism.
