The assessment of the rules contained in the Acquis project withrespect to the duty of preliminary information allows the Author tostudy in depth the models of protection in the formation of contract.In fact the Acquis rules also take into consideration the currentlyprevailing ideas as to the planning phase of a common European regulationof contract, as shown by the acceptance of the mentionedrules, though slightly modified, in the Draft Common Frame of Reference.The Acquis Principles, indeed, are not just a simple collection ofEuropean Directives already adopted on this topic, but the outcomeof a more ambitious choice, where the combination of words "applicablelaw" (diritto vigente) has a particular meaning: the rules are, infact, the result of two different operations, both leading to innovationof current laws: on the one hand, with respect to the duties of conduct;on the other hand, with respect to the remedies triggered by theinfringement of those duties.
