The present essay explains the various questions about the operation of the claims made contract in the Italian legal system, especially in the light of the last sentence of the Court of Cassazione (United Sections, n. 22437/2018). In particular, the attention is focused on the relationship between the insurer and the insured and on the so-called “suitability principle”, which is used, in the essay, as a tool to protect professional contracting.
Il presente saggio affronta le varie problematiche legate alla piena operatività del contratto claims made nell’ordinamento giuridico italiano, soprattutto alla luce dell’ultimo intervento in materia da parte delle Sezioni Unite della Cassazione (Cass. civ., Sezioni Unite n. 22437/2018). L’attenzione si focalizza in particolare sulla relazione negoziale tra assicuratore e assicurato e sul “principio di adeguatezza” (artt. 119-bis e ter Cod. ass. priv. e art. 58 Reg. IVASS n. 40/2018), che viene elevato a specifica tecnica di protezione per il contraente professionista.
