Kelsen su causalità e giustizia

The Journal "Erkenntis" printed the number VII in 1940 but, due to the outbreak of war, it was published only in 1976. The number contained an undoubtedly significant essay by Hans Kelsen dedicated to the social and normative interpretation of nature in particular and to the genesis of political order in general. Essential in this study is the discover of the emancipation of the idea of causality from the principle of retribution. Kelsen's text is publicated in Italian for the first time. My essay "Kelsen tra causalità e giustizia" ["Kelsen between Causality and Justice"] introduces my Italian translation of Kelsen's "Causality and Retribution", showing its relevance in the comprehension of the figure and thought of an author widely studied for his juridical works but neglected in his significant works on social epistemology. The essay also highlights how Kelsenian philosophical investigations on the genesis of the logical forms of normative thought, from primitive societies to presocratic philosophy of nature, mainly devoted to the relationship between 'causality' and 'juctice', are of great interest for political philosophy.

La rivista "Erkenntnis" stampò il numero VII nel 1940. Tuttavia, a causa dello scoppio della guerra, venne pubblicato solo nel 1976. Il numero conteneva un saggio oltremodo importante di Hans Kelsen, dedicato in particolare all'interpretazione sociale e normativa della natura e in generale al problema della genesi dell'ordine politico. Ciò che in questo lavoro emerge con forza è l'idea dell'emancipazione della causalità dal principio di retribuzione. Questa è la prima edizione italiana del testo di Kelsen. Il mio saggio "Kelsen su causalità e giustizia" introduce la traduzione italiana di "Causality and Retribution" di Kelsen, mostrando l'importanza di quest'opera ai fini dell'intelligenza della figura e del pensiero di un autore principalmente noto per i suoi studi giuridici ma trascurato nei suoi studi sull'epistemologia sociale. Il mio saggio inoltre evidenzia come le ricerche filosofiche di Kelsen sulla nascita delle forme logiche del pensiero normativo, dalle società primitive alla filosofia presocratica della natura - con particolare riguardo alla relazione tra 'causalità' e 'giustizia' - sono di grande interesse per la filosofia politica.
