On the gaian assumption of the familiaritas aliqua between emptio-venditio and locatio-conductio, attention is focused on the three cases in point of legal controversies given that, being all characterized by the survival of elements of both the two consensual contracts, they appeared 'border-line' for the purposes of their negotiation framework. In reconstructing the exact extent of the debate that arose between the iuris prudentes, now for the concession of the praedia municipum, now for the hiring of gladiatores, now for the conventio cum aurifice, the aim is to suggest a renewed exegesis of the related testimonies of the Institutiones, Gai. 3.145-147, which, without letting ourselves be 'influenced' by modern dogmatic schemes, has only knowledge of the legal instruments available to the Roman jurists. This is to offer the contractual qualification attributed by the prevailing jurisprudence to each controversial relationship an explanation that is not only completely satisfactory, functional and balanced on a logical-juridical level but also, and above all, absolutely adherent and faithful to the passages of Gaius, which deserve much more credit than the doctrine has to date recognized them.
Sul presupposto gaiano della “familiaritas aliqua” intercorrente tra emptio-venditio e locatio-conductio, l’attenzione viene focalizzata sulle tre fattispecie oggetto di querelle giurisprudenziale posto che, essendo tutte contraddistinte dalla convivenza di elementi propri di entrambi i due contratti consensuali, apparivano ‘border-line’ ai fini del loro inquadramento negoziale. Nel ricostruire l’esatta portata del dibattito sorto tra i iuris prudentes, ora per la concessione dei praedia municipum, ora per l’ingaggio dei gladiatores, ora per la conventio cum aurifice, l’obiettivo è quello di suggerire una rinnovata esegesi delle relative testimonianze delle Institutiones, Gai. 3.145-147, che, senza lasciarsi ‘suggestionare’ dagli schemi dogmatici moderni, abbia unicamente contezza degli strumenti giuridici di cui potevano disporre i giuristi romani. Questo per giungere ad offrire della qualifica contrattuale attribuita dalla giurisprudenza prevalente a ciascun rapporto controverso una spiegazione non solo del tutto soddisfacente, funzionale ed equilibrata sul piano logico-giuridico ma anche, e soprattutto, assolutamente aderente e fedele ai brani di Gaio, che meritano molto più credito di quanto la dottrina ad oggi abbia ad essi riconosciuto.
