The book deals with the issue of the omissions of the legislator, focusing on the juridical-constitutional problems that can derive from them and highlighting the approaches taken by ordinary and constitutional jurisprudence to try to remedy them. By carrying out a critical analysis, the problems of this approach are highlighted and some possible remedies are proposed.
Il volume affronta il tema delle omissioni del legislatore, soffermandosi sui problemi giuridico-costituzionali che dalle stesse possono derivare ed evidenziando gli approcci avuti dalla giurisprudenza, ordinaria e costituzionale per tentare di porvi rimedio. Utilizzando una chiave di analisi critica, vengono evidenziate le problematicità di siffatto approccio e proposti alcuni possibili rimedi.
