This volume brings together contributions on civic uses and collective domains, analyzed as a long-term legal phenomenon, constantly interacting with community practices, regulatory interventions, and institutional structures. Drawing on a historical perspective spanning the Middle Ages, the modern era, and the contemporary era, the essays diachronically reconstruct the transformations of collective land ownership and the persistent difficulties in fitting them into legal categories based on the model of individual ownership. Overall, the volume seeks to prompt critical reflection on the legal relevance of collective domains and the prerequisites for their protection and management for the shared care of common resources.
Il volume raccoglie contributi dedicati agli usi civici e ai domini collettivi, analizzati come fenomeno giuridico di lunga durata, in costante confronto con pratiche comunitarie, interventi normativi e assetti istituzionali. Muovendo da una prospettiva storica che attraversa medioevo, età moderna e contemporanea, i saggi ricostruiscono in maniera diacronica le trasformazioni degli assetti fondiari collettivi e le persistenti difficoltà di ricondurli entro categorie giuridiche fondate sul modello della proprietà individuale. Nel suo insieme il volume vuole sollecitare una riflessione critica sulla rilevanza giuridica dei domini collettivi e sui presupposti della loro tutela e gestione per una cura condivisa delle risorse comuni.
