Prior to the late ancient period the observation that all men are equal by natural right, theorized also in pre-classical cultures, did not reach social conscience, which was still anchored to the primary rule that recognised the term naturalis as meaning ‘conform to the nature of things’; the same meaning that the wording held in philosophical and legal disquisitions, did not succeed in encouraging, in Roman society, though Christianised, the surmounting of the summa divisio “homines aut liberi sunt aut servi”.
La constatazione che tutti gli uomini sono eguali per diritto naturale, teorizzata anche nelle culture preclassiche, non informò, se non in epoca tardoantica, la coscienza sociale, rimasta ancorata al precetto primario che riconosceva al termine naturalis il significato di ‘conforme alla natura delle cose’; la stessa pregnanza, che la formulazione rivestì nelle disquisizioni filosofiche e giuridiche, non riuscì a favorire, nella società romana, ancorché cristianizzata, il superamento della summa divisio “homines aut liberi sunt aut servi”.
