The renewed exegesis of D. 9.2.9 pr.-1, on the death of a slave by medicamenti datio, confirms the Labeon’s opinion, who recognizes as occidere the act of medicamentum suis manibus infundere (even in absence of violence); it also puts the focus on the different classification of the subject giving out the potion (in the principium a midwife while in the § 1 a not professionally qualified agent), as a key to explain references to the violence and persuasion in the § 1, intended to exclude the possible contributory negligence of the damaged (without contradicting D. 9.2.7.6).
