The Right to Education The Chapter provides a brief commentary on Articles 28 and 29 of the United Nations Convention on the Right of the Child (CRC), both devoted to the right to education. It analyses the core contents of these fundamental guarantees, to be read together, as well as the nature and scope of States’ obligations to respect, protect and fulfil the right in question “progressively and on the basis of equal opportunity” (Art. 28). Starting from the meaning of ‘education’ in the context of the CRC, the text offers an overview of the four qualitative dimensions of the right to education as compared to other international human rights provisions and interpreted by the UN monitoring bodies and the Special Rapporteur: availability, accessibility, acceptability and adaptability (the 4A framework). It also explores the requirement for a right-based approach to school discipline, grounded on the dignity of the child, and the international cooperation in matters relating to education. Finally, it focuses on the implementation of the CRC international standards within the Italian legal order, as a reference tool for those working in the field of children’s rights and educational matters.
