D. 50.16.203: Alfeno Varo, l’Italia e la Sicilia. Spunti per una riflessione sul ‘geodiritto’ romano

The article highlights the strong ‘constitutional’ contrast between Sicily and the Italian peninsula unequivocally attested by Liv. 027.5.14 at the end of the third century B.C. and, between the end of the Republic and the beginnings of the Principate, by Alfenus Varus in D. 50.16.203 and 39.4.15, who considered these two territorial areas as two completely separate geographical and administrative realities. And traces and echoes of Alfenus’s legal perception of the insula Siciliae in terms of a strong institutional contrast between this province and Italy can be found in D. 50.16.99.1, D. 1.2.2.32 and Nov. 24praef

L’articolo evidenzia la forte contrapposizione ‘costituzionale’ tra la Sicilia e la penisola italica attestata inequivocabilmente da Liv. 27.5.15 alla fine del III sec. a.C. e, tra la fine della Repubblica e gli inizi del Principato, da Alfeno Varo in D. 50.16.203 e 39.4.15, che considerava questi due ambiti territoriali come due realtà geografiche e amministrative del tutto separate. E tracce ed echi della percezione giuridica di Alfeno dell’insula Siciliae nei termini di una forte contrapposizione istituzionale tra questa provincia e l’Italia sono rinvenibili in D. 50.16.99.1, D. 1.2.2.32 e Nov. 24 praef.
