La 'cognitio senatus'

The contribution aims to be a dutiful tribute to that sector of the scientific activity of Professor Franca de Marini Avonzo who found an admirable synthesis in a survey which, arriving at an almost complete knowledge of the jurisdictional function of the senate in the imperial age, still constitutes today an exemplary model for future research, thus configuring itself as an indispensable consultation and work tool and, together, an essential point of reference both for historians and for jurists who will be able to deal with the functioning and role of the senatorial assembly in the Principate. And, indeed, it must be recognized that the senatorial jurisdiction provides important elements of evaluation in relation to the political-institutional importance had by the patres in that era, thus leading to revise the undeserved and still prevailing judgment of almost total devaluation of the role played by the assembly senatorial during the Principate, along whose historical unfolding the senatorial assembly maintained its vitality and influence. Even if between ups and downs, even if this certainly does not help to configure the senate as a body capable of constituting a valid alternative to excessive power imperial, of which in any case the senatorial jurisdiction clarifies some fundamental aspects.

Il contributo vuole essere un doveroso tributo a quel settore dell’attività scientifica della Professoressa Franca de Marini Avonzo che ha trovato una mirabile sintesi in un’indagine che, giungendo ad una pressoché completa conoscenza della funzione giurisdizionale del senato nell’età imperiale, costituisce ancora oggi un modello esemplare per le future ricerche, configurandosi pertanto come un indispensabile strumento di consultazione e di lavoro e, insieme, un imprescindibile punto di riferimento sia per gli storici e sia per i giuristi che avranno modo di occuparsi del funzionamento e del ruolo dell’assemblea senatoria nel Principato. E, invero, deve riconoscersi che la giurisdizione senatoria fornisce importanti elementi di valutazione in ordine al rilievo politico-istituzionale avuto dai patres in tale epoca, inducendo così a rivedere l’immeritato ed ancor oggi prevalente giudizio di svalutazione pressoché totale del ruolo svolto dal consesso senatorio durante il Principato, lungo il cui storico dispiegarsi l’assemblea senatoria mantenne, pur se tra alterne vicende, la sua vitalità ed influenza. Anche se ciò non giova certo a configurare il senato come un organo in grado di costituire una valida alternativa allo strapotere imperiale, del quale in ogni caso la giurisdizione senatoria chiarisce alcuni aspetti fondamentali.
