Persone, natura e diritti

In this contribution we want to offer an argument in favour of regaining the biological and ontological basis of the human person, without rejecting the artificial in the name of the natural, but by defining the two dimensions and specifying the relationships. We defend the claim that the concept of person is logically prior to the contingent properties such as individual consciousness, since it constitutes the substratum that supports all the other qualities of the human being. This argument has significant implications in the ethical field of the respect due to persons and in the legal field of the ascription of rights.

In questo contributo si intende offrire un’argomentazione a favore dell’esigenza di recuperare i fondamenti biologici ed ontologici della persona, senza rifiutare l’artificiale in nome del naturale, ma delimitando le due dimensioni e specificandone le relazioni. Si difende la tesi secondo cui il concetto di persona è logicamente prioritario rispetto a proprietà contingenti quali la coscienza individuale, costituendo esso il sostrato che sostiene tutte le altre qualità dell’essere umano. Tale tesi ha implicazioni significative sia sul piano morale del rispetto dovuto alle persone, sia sul piano giuridico dell’ascrizione di diritti.
