The essay starts with a reflection on different methodological approaches to constitutional law and the normative use of the comparison. The Author, then, examines the integration of the parameters of legitimacy in the jurisprudence of the Italian Constitutional Court, stressing how a dynamic methodological perspective is more adequate for the protection of fundamental rights, while the safeguarding of the institutional framework of adoption of the choices is the object of attention prevailing in other approaches. Finally, the A. emphasizes how the multi-level constitutionalism now prevailing in Europe imposes to national judges to deal with other National Courts, acting as real instruments of supranational integration of their systems.
Il saggio si apre con una riflessione sui differenti approcci metodologici al diritto costituzionale e sull’uso normativo della comparazione. Si passa, quindi, all’esame dell’integrazione dei parametri di legittimità nella giurisprudenza della Corte costituzionale italiana, sottolineando come una prospettiva metodologica dinamica sia più adeguata alla tutela dei diritti fondamentali, mentre la salvaguardia della cornice istituzionale di adozione delle scelte sia oggetto di attenzione prevalente in altri approcci. Infine, si sottolinea come il costituzionalismo multi-livello ormai imperante in Europa imponga ai giudizi nazionali di confrontarsi con le altri Corti nazionali, agendo come veri e propri strumenti di integrazione sovranazionale dei rispettivi ordinamenti.
