Scholars fully agree on the fact that any loan of money to a child-in-power became a collectable credit only if and when the pater familias had died and the filius familias had inherited his estate. The indebtedness of the sons had then brought to the senatusconsultum Macedonianum meant to fight the danger of parricidium which was a likely consequence of the above-mentioned mechanism. Such conceptions about the reasons of the senate rule and its purposes are though disputable on textual and juridical grounds, so that a new interpretation is given of some expressions of the senatusconsultum Macedonianum such as ‘incertis nominibus credere’ and ‘ne …, etiam post mortem parentis eius, cuius in potestate fuisset, actio petitioque daretur’.
Secondo il concorde orientamento della dottrina, la mancanza di un patrimonio in capo al filius in potestate faceva sì che ogni prestito di denaro concesso in suo favore diveniva credito esigibile soltanto quando il filius, morto il pater, avesse ereditato le sostanze paterne, trovandosi così nella condizione di poter adempiere. Sarebbe stato l’indebitamento dei figli, quindi, a provocare l’emanazione del senatusconsultum Macedonianum mediante il quale il senato, privando di tutela processuale la mutua pecunia erogata ai filii familias, intervenne per disinnescare il pericolo di parricidium che si annidava in quel tipo di prestito. Sennonché siffatta communis opinio sulle motivazioni della disposizione senatoria e gli obiettivi che con essa si intesero perseguire, suscita delle perplessità – sia di ordine testuale sia logico-giuridiche – che inducono a riesaminare il dettato normativo, per giungere ad una diversa interpretazione delle espressioni in esso contenute ‘incertis nominibus credere’ e ‘ne …, etiam post mortem parentis eius, cuius in potestate fuisset, actio petitioque daretur’.
