The article reflects on the legitimacy of the preventive confiscation in the light of the European and comparative debate on non–conviction based confiscation. It analyses the recent trends of the relevant legislation, - also on the basis of the legislative draft n. 2134 -, which extends the scope of this form of confiscation from the fight against organized crime to economic crime and, indeed, of the pubblic administration, despite the demands of the European Court of Human Rights to a more consistent application of the principle of legality (precision) in the identification of the recipients, in particular for the category of “ordinary dangerousness” (De Tommaso case). In the light of EHR Court’s positive attitude towards forms of actio in rem, the author doesn’t believe in a change of the Court’s position in relation to preventive confiscation (- more respectful of the safeguards and coherent with its autonomous concept of criminal matter -). In conclusion the article evaluates the possibility to introduce a criminal proceeding against the assets in consideration of the recent EU Proposal for a regulation on the mutual recognition of freezing and confiscation orders, also without conviction, issued in the framework of criminal proceedings; the reference model adopted by the European legislator is § 4 of the German draft - BReg418 / 16 - for the implementation of Directive 42/2014.
L’articolo riflette sulla legittimità della confisca di prevenzione alla luce del dibattito europeo e comparatistico sulla confisca senza condanna, analizzando le recenti tendenze, anche in base al d.d.l. 2134, della legislazione in materia che sempre più ne estende l’ambito di applicazione, dalla lotta al crimine organizzato alla criminalità economica e, addirittura, della p.a.; ciò nonostante le sollecitazioni della Corte europea a un’applicazione maggiormente conforme al principio di tassatività proprio nell’individuazione dei destinatari a pericolosità generica (sentenza De Tommaso). Pur non confidando in un più garantista e coerente atteggiamento da parte della Corte europea nei confronti della confisca di prevenzione, - alla luce del suo uniforme orientamento di favore verso forme di actio in rem -, si ragiona sulla possibilità di concepire un modello penalistico di processo al patrimonio in considerazione della recente proposta di Regolamento UE sul mutuo riconoscimento dei provvedimenti di confisca, anche senza condanna, purché pronunciati in un procedimento penale; regolamento che adotta come modello di riferimento il progetto di legge tedesco per l’implementazione della direttiva 42/2014.
