Immediately after the entry into force of the Lisbon Treaty, establishing the legal base for the setting up of the European Public Prosecution Office (EPPO), the issue of the material. scope of such an European office has been somehow marginalized. Indeed, the wording of the treaty appears to be very ambiguous. However, the definition of the material scope of the EPPO cannot be considered but an essential piece of the overall system of criminal justice which is going to be designed. In this chapter the Author critically analyses the relevant provisions in the treaty, showing also the very negative impact of their ambiguity on the definition of the contents of the legal texts adopted to implement them and regulate the daily action of the new body.
