Within the different opinions formulated by the prevailing doctrine, a review of the most significant sources about fictio civitatis and a reinterpretation of the incisor si civis Romanus esset contained in Gai. 4.37 is proposed, also in relation to the classifications of ordo iudiciorum privatorum as described by the jurist in the IV commentary of his institutional manual.
