The almost common doctrinal opinion which excludes the ‘naturale’ character of the servile creditum towards an extraneus, is questioned through the careful exegesis of D. 44.7.14 (Ulp. 7 disput.), in order to give the right value to the Ulpiano’s expression ‘servi naturaliter obligant’, which cannot be separated from the accurate analysis of the larger context in which it is used: the relationship between the classical jurisprudential notion of naturalis obligatio, including the compulsory restrictions of a servus, and the praetorian regulations concerning peculium.
Il pressoché comune orientamento dottrinale volto ad escludere carattere ‘naturale’ al creditum servi verso un extraneus, viene messo in discussione attraverso una puntuale esegesi di D. 44.7.14 (Ulp. 7 disput.), al fine di attribuire la giusta portata all’espressione ulpianea ‘servi naturaliter obligant’, la quale non può prescindere dall’attenta analisi di un contesto più ampio, in cui essa si inserisce: quello dei rapporti tra la nozione giurisprudenziale classica di naturalis obligatio, comprensiva dei vincoli obbligatori di cui è parte un servus, e le regolamentazioni pretorie in materia di peculium.
