Contrasto alla maladministration e segnalazione di irregolarità: il whistleblowing e la (ri)conversione etica dei dipendenti pubblici

The paper deals with the law regulating whistleblowing in the public sector, starting from the introduction, by Law no. 179 of 2017, of a new protective discipline for whistleblowers. After an analysis of the notion of whistleblowing and of its antecedents in Italian case law, the paper focuses on scope and contents of the legal protection for the whistleblowers and on the possible interferences of these “special” protective measures with the “ordinary” techniques used in employment protection legislation. In the final pages, the Author proposes some systematic reflections on the regulation of whistleblowing as an institute situated on the borders between public and private employment law.

Il saggio analizza la disciplina del whistleblowing nel settore pubblico, a margine dell’introduzione, ad opera della legge 179/2017, della nuova legislazione protettiva per i dipendenti che segnalano irregolarità. Dopo aver analizzato la nozione di whistleblowing e i suoi antecedenti giurisprudenziali nell’ordinamento interno, la trattazione si sofferma su campo di applicazione e contenuti delle tutele predisposte dal legislatore, nonché sulle possibili intersezioni delle protezioni “speciali” per i whistleblower con le “ordinarie” formule protettive giuslavoristiche. Infine, nelle ultime pagine si propongono alcune riflessioni in chiave sistematica sulla disciplina della segnalazione di irregolarità, suscettibile di rappresentare un istituto di confine tra lavoro pubblico e privato.
