Etica comportamentale, procedimento disciplinare e sanzioni. L'homo novus nel pubblico impiego?

The essay deals with the issue of disciplinary power in public employment, fo- cusing on the elements – introduced by the legislative reforms implemented in 2009 and 2017 – that made art. 55 of the Legislative Decree no. 165/2001 the symbol of the divergences between private and public sector employment. In particular, the au- thor argues that the new sources system, the strengthening of the sanctions and the mandatory nature of the disciplinary action make the disciplinary power a sort of or- dinary tool of management of employment relationship, in the direction of “a new behavioural ethics” aimed at a recovery of public administration’s efficiency.
