According to a judgment of the Court of First Instance of Treviso, both the French and the German law entitle the former spouse to claim maintenance from the other one primarily to compensate the disadvantages that, as a result of the marriage, have occurred with regard to the possibility to taking care of his own maintenance. Nevertheless, a thorough analysis of the above mentioned rules cannot confirm this theory. Furthermore, the Court emphasises the need to take into particular account the contribution that each spouse gave to the family life and to the matrimonial property. Lacking such a contribution, the maintenance claim of the divorced spouse is to be reduced to cover the essential necessities of life. However, he has not such a claim against the other spouse if he did not look thoroughly for a job before the end of the marriage.
Il Tribunale di Treviso, affermata la prevalenza della funzione perequativo-compensativa dell’assegno divorzile su quella assistenziale, nega il diritto all’assegno al coniuge privo di mezzi che non si era adoperato a sufficienza per trovare un’occupazione. Il caso solleva le seguenti questioni: se detta interpretazione della funzione dell’assegno trovi davvero conferma nel contesto giuridico europeo, come sostiene il Collegio; se, in difetto di ragioni compensative, l’assegno possa comunque essere riconosciuto in base al criterio assistenziale ed in che misura; se, ricondotto l’assegno alla misura alimentare, esso spetti anche al coniuge che non si sia adoperato a sufficienza per sottrarsi al proprio stato di bisogno.
