Abstract. The essay examines one of the most controversial points of P. Giss. 40.I concerning the ex-ception clause of the concession of the civitas Romana. Through the coordinated analysis of numerous papiraceous and epigraphic testimonies, the restitution χωρ[ὶς] τῶν [δε]δειτικίων is refuted, thus dis-proving the dominant thesis of the universal concession of citizenship. On the basis of the different in-tegration χωρ[ὶς] τῶν [ἀπολ]ειτικίων we come to the conclusion that Caracalla's measure had a gen-eral but not universal scope because it excluded from citizenship not the peregrini dediticii, but the pere-grini nullius civitatis (or ἀπόλιδες), i.e. all those peasant or tribal masses organized in forms incompati-ble with the paradigm of the city, measure of a sufficient stage of Romanization necessary for the granting of citizenship.
