C'è ancora bisogno di una Costituzione europea?

The paper focuses on the debate on whether the EU should be provided with a Constitution. Highlighting the reasons that led to the failure of the “Treaty establishing a Constitution for Europe”, the study stresses that, after the entry into force of the Treaty of Lisbon, the EU is to be considered already provided with norms that are constitutional in nature, despite the fact it is not a State. Nevertheless, the conclusion is that a true formal Constitution is still needed in order to overcome all the limits the EU institutional set-up and functioning have revealed because of the compromise reached with the Lisbon Treaty.
