While the problem of the policy of rejections at sea has finally been ruled on, with an explicit condemnation by the European Court on the grounds of its obvious contradiction to the principle of non-refoulement, the blocking and the subsequent entry of a significant number of immigrants to European territory has raised other important issues such as the effect of an excessive load of asylum applications. The purpose of this paper is to explore the body of rules governing the migration phenomenon while highlighting the need for a common asylum procedure to implement a uniform system at a European level for asylum seekers, something that the adoption of the new Dublin III regulations offers. This paper concludes by emphasising the need for the recognition of the status of asylum seekers and possible solutions provided by the European system in order to avoid the fragmentation of the procedures for such recognition, while seeking to reduce the burden that the acceptance of a considerable number of requests for asylum, may weigh on one country.
