The pandemic emergency produced disruptive effects, deriving from regulatory provisions aimed at protecting employees’ health and safety, on both working times and workplaces. The tool of remote work, widespread both in private companies and in public administrations, induced the remotization and the relocation of working activities. With regard to on-site work, especially after the restarting of the economic activities, multiple measures for increasing flexibility and encouraging shifts have been introduced, aimed at organizing the presence of groups of workers in the company or in the offices. In this regard, the Author focuses on some issues relevant for labour and trade union law, arising from the implementation of these measures, and then finally analyses their effects on the social organization, also in a post-pandemic perspective.
L’emergenza pandemica ha prodotti effetti dirompenti sull’assetto dei tempi e dei luoghi di lavoro, derivanti da disposizioni normative finalizzate a tutelare la salute dei lavoratori. Lo strumento del lavoro agile, diffuso sia nelle aziende private sia nelle p.a., ha indotto la remotizzazione e delocalizzazione della prestazione di lavoro. Per quanto riguarda il lavoro in presenza, specie a seguito del riavvio delle attività produttive, sono state introdotte misure finalizzate a incrementare la flessibilità e a favorire turnazioni, in modo da differenziare la presenza di gruppi di lavoratori in azienda o negli uffici. L’a. si sofferma al riguardo su alcune questioni giuridico-sindacali derivanti dall’attuazione di tali misure, per poi infine analizzarne le ricadute sugli assetti dell’organizzazione sociale, anche in prospettiva post-pandemica.
