The order of the Court of Cassation, 25 January 2021, no. 1476, confirms the orientation already emerged with the order February13, 2020, n.3643 of the same First section, consolidating in our legal system the acceptance of the institution of “mild adoption” and the extensive interpretation of art.44, lett. d), L. 4 May 1983, n. 184. The commentary highlights the particularity of the institution of simple adoption in international law, as a crossroads of opposing conceptions, and analyzes the placement of the balancing of interests phase in the procedure of adoptability of the minor, underlining the need to overcome the current jurisprudential orientation and, more generally, to rethink the nature of the list of art. 44.
L’ordinanzadellaCortedicassazione, 25gennaio2021 ,n.1476, conferma l’orientamento già emerso con l’ordinanza 13 febbraio 2020, n. 3643 della stessa Prima sezione, consolidando nel nostroordinamento l’accoglimento dell’istituto della c.d.“adozione mite”el’interpretazione estensivadell’art. 44, lett. d), L. 4 maggio 1983, n. 184. Nella nota di commento si mette in luce la particolaritàdell’istituto dell’adozione non legittimante nel panorama del diritto internazionale, quale crocevia diopposte concezioni, e si esamina la collocazione del bilanciamento di interessi nella procedura diadottabilità del minore, sottolineando l’esigenza di un superamento dell’attuale orientamento giurisprudenziale e, più in generale, di un ripensamento sulla natura tassativa dell’elenco dell’art. 44.
