The package of Italian laws for the reform of sport states the principle of protection of minors as of primary importance, especially for youngsters entering in the world of sport. However, the legal form for contracts with the sports agent includes one legal requirement that might be counterproductive in some types of cases, especially when it comes to contracts for young professionals. Having identified and examined such cases, the author suggests a restrictive functional interpretation for this requirement, according to which it would apply exclusively to amateurs who are not hired by professional clubs
