In this paper I present some remarks on the nature of social rights from the perspective of political philosophy and the philosophy of constitutional law. I examine here two eminent positions in contemporary legal and political philosophy (Alexy, Rawls). The topics I identify are five: 1) what social rights are; 2) how social rights are guaranteed; 3) who are the recipients of social rights; 4) whether, and in what sense, social rights can be defined as “rights”; 5) the enforcement of social rights.
