The aim of this article is to introduce the reading of Samuel Stryk’s Treatise ‘De iure sensuum’. This late 17th-century source is an exemplary historical text for studying the relationship between law and ‘human sensitivity’ in a context that still makes use of the great experience of the ius commune but also measures itself against new inflexible situations and the erosion of the ancient unitary of legal instruction. The study focuses on the advance of modern episteme, which makes the empirical data and the orbis sensualium the privileged subject of knowledge and which also calls for new ways of approaching the problem of the scientific nature of jurisprudence.
