Soltanto il convivente che non dimostri i propri sacrifici professionali perde l’assegno divorzile

According to the Italian law, the alimony cheque owed by a former spouse to the other one comes to an end if the latter remarries. Applying such a rule to a cohabitation would affect the former spouse who undertakes a de facto relationship. Therefore, the United Sections of the Italian Supreme Court affirmed the right of the former spouse in need to receive a monetary compensation for giving up his or her career in order to take care of the family and of the children. However, this results in an inequality of treatment between cohabitation and remarriage, which could only be overcome by extending the same rule to the latter. Furthermore, there is a lack of protection of the former spouse whose state of need isn’t connected to the family life arrangements, despite the absence of a provision that provides such an effect.

L’equiparazione tra matrimonio e convivenza sul piano degli effetti sull’assegno divorzile rischia di costituire una soluzione fortemente penalizzante per il soggetto che, con un matrimonio fallito alle spalle, abbia deciso di intraprendere una convivenza. Le Sezioni Unite ne sono consapevoli ed hanno ravvisato una tutela per il convivente nella continuazione dell’assegno divorzile, con funzione esclusivamente compensativa. Questa soluzione crea, però, un’ingiustificata disparità di trattamento tra la convivenza e le nuove nozze, che potrebbe essere superata soltanto estendendo a queste ultime la soluzione delineata per la convivenza. Inoltre, essa lascia senza tutela l’ex-coniuge che, pur non avendo provato di avere sostenuto sacrifici professionali nell’interesse della famiglia, si trovi in stato di bisogno, nonostante manchi una disposizione che preveda l’effetto estintivo di cui si discute.
