The essay is inspired by the comparison between the Proposal for a Directive on improving working conditions in platform work, presented by the European Commission on 9 December 2021, and the Draft Report of the European Parliament (Rapporteur, E. Gualmini) of 3 May 2022. The latter proposes a series of amendments to original text, the most significant of which concern the legal presumption of employment relationship, the extension and strengthening of rights relating to algorithmic management. The Author focuses, in particular, on the usefulness of a European notion of “platform worker” and on the opportunity to maintain, in the directive, its identification criteria, to avoid the risk of an excessive fragmentation of the notion, with application of the legal presumption of employment relationship not homogeneous in national legal systems.
