Caducazione del titolo esecutivo e giudizio di opposizione all’esecuzione

The paper deals with the issue of the consequences of the lapse of the enforceable title on the proceedings initiated by the debitor pursuant to article 615 of the italian civil procedure code in order to challenge the execution. Special attention is paid, in this analysis, to the recent judgment no. 24578 of 2021 of the United Sections of the Court of Cassation, which solved (without however dispelling all the doubts) the conflict that arose in this regard between the Simple Sections.

Il contributo analizza il problema delle conseguenze della caducazione del titolo esecutivo in pendenza del giudizio di opposizione all’esecuzione ex art. 615 c.p.c., anche alla luce della recente sentenza n. 24578 del 2021 delle sezioni unite della Corte di cassazione, che ha composto (senza peraltro fugare tutti i dubbi) il contrasto sorto al riguardo tra le sezioni semplici.
