The paper aims to analyze certain contentious issues related to legal protection of disability, with particular regard to legal remedies against the omitted implementation of the administrative instruments of support. Moving from the ‘living law’ analysis related to allocation of jurisdiction in the area, the paper tries to identify from a constitutionally-oriented perspective the legal foundation and the extent of the administrative responsibility for the non-provision of the services provided for by Law.
