‘Stranieri-nemici. Il riconoscimento del diritto di difesa agli hostes iniusti. Voci di giuristi tra i secoli XIV e XV’,

The theme of the identification of friendly and foreign peoples is the thread that allows us to follow the complex web of transformations of the concept of ius belli and the role played, from a legal point of view, by the iusta causa that legitimises war in defence. The path that jurists follow is for a long period based on the unilaterality of war, just for only one of the belligerent parties, this consideration consequently nullifies the right of resistance of foreign peoples, enemies who cannot defend themselves if justly attacked. From the 15th Century onwards, jurists began to correct the strong imbalance determined by traditional theories of lawful war by recognising reciprocity for enemies and consequently the equal right of defence, beginning the long process of transforming the figure of the unjust hostes.

Il tema dell’individuazione dei popoli amici e dei popoli stranieri rappresenta il filo conduttore che consente di seguire la complessa trama delle trasformazioni del concetto di ius belli e del ruolo svolto, sotto il profilo giuridico, della iusta causa che legittima la guerra a difesa. Il percorso che i giuristi seguono è per un lungo periodo fondato sull’unilateralità della guerra, giusta per una sola delle parti belligeranti: questa considerazione annulla di conseguenza il diritto di resistenza dei popoli stranieri, nemici che non possono difendersi se attaccati giustamente. A partire dal secolo XV i giuristi iniziano a correggere il forte sbilanciamento determinato dalle tradizionali teorie sulla guerra lecita riconoscendo ai nemici la reciprocità e di conseguenza il pari diritto di difesa dando inizio al lungo processo di trasformazione della figura degli hostes iniusti.
