Is Article 1417 of the Italian Civil Code, which lays down rules on proof of simulation of contract, applicable to fictitious interposition of persons? And, even before that, is art. 1414 para. 2 of the Italian Civil Code on the effects between the parties of simulation applicable to the case of subjective simulation? The study focuses on this question and concerns a judgement on the case of an auction sale that took place in breach of the rule (579 of the Italian Code of Civil Procedure) prohibiting the debtor who has been enforced from making himself the purchaser of his own goods sold at auction. Once the difference between real and fictitious interposition of person has been traced, and the thesis that limits the application of Articles 1414-1417 of the Italian Civil Code to objective simulation has been analysed, it is on the ground of the proof of the dissimulated transaction that must be made in writing under sanction of invalidity that the issues center, especially where it conceals an unlawful agreement.
È applicabile l'art. 1417 c.c., in materia di prova della simulazione, all'interposizione fittizia di persona? E, ancor prima, è riferibile al caso della simulazione soggettiva il 20 comma dell’art. 1414 c.c. sugli effetti tra le parti della simulazione relativa? Attorno a questo interrogativo si muove il commento, avente ad oggetto una sentenza di merito chiamata a giudicare un caso di vendita all’incanto avvenuta in violazione della norma (579 c.p.c.) che fa divieto al debitore esecutato di rendersi acquirente dei propri beni venduti all'asta. Ripercorsa la differenza tra interposizione reale e fittizia di persona, e analizzata la tesi che riduce alla simulazione oggettiva (o di negozi) l’applicazione degli artt. 1414-1417 c.c., è sul terreno della prova del negozio dissimulato sottoposto alla forma scritta a pena di invalidità che si concentrano gli interrogativi, specie laddove nasconda una fattispecie contrattuale illecita.
