Tutela dell’ambiente, aree protette e governo del territorio: spunti comparatistici e prospettive dopo la modifica dell’art. 9 Cost.

The essay proposes a partial reinterpretation of the current division of regulatory competences in the field of the environment, on the basis of the changes made to Article 9 Const. by Constitutional Law no. 1/2022. Then, it checks the appropriateness of this thesis both in the light of the current internal regulation on protected natural areas, as well as the experience gained within the Spanish legal system. Finally, the real ability of the Italian Regions to take charge of the protection of ecosystem is questioned, owing also to some factors seemingly hindering that.

L’articolo prospetta una parziale rilettura dell’odierno riparto verticale delle competenze in tema di ambiente, sulla base delle modifiche apportate all’art. 9 Cost. dalla legge costituzionale n. 1/2022, per poi verificarne la sostenibilità sia alla luce della vigente disciplina interna sulle aree naturali protette, sia dell’esperienza maturata, nella medesima materia, in seno all’ordinamento spagnolo. Infine, ci si interroga sull’effettiva capacità delle Regioni italiane a farsi carico della tutela degli ecosistemi, stante la concorrenza di alcuni fattori che sembrano, invece, ostacolarla.
