The Electronic Health Record, also in light of the most recent national and European regulations, is destined to become one of the key tools of digital healthcare. The paper provides a legal framework of the EHR, focusing, in particular, on the way in which the rules and principles of data processing affect its nature as a therapeutic- diagnostic tool, in support of the traditional relationship of care and trust, and an information system aimed at pursuing broader public purposes.
