Following the introduction of the AI Act, issues are being raised about its relationship with the General Data Protection Regulation (Regulation 2016/679) and, more generally, about the inextricable and unavoidable link between data (personal and non-personal) and artificial intelligence applications. On the one hand, artificial intelligence, through machine learning, needs an enormous amount of data to learn and make better decisions; on the other hand, artificial intelligence makes it possible to draw increasingly concise and precise conclusions from data, which are then incorporated into digital information flows. Artificial intelligence applications destabilise the balance introduced and established by the GDPR regulations, casting doubt on their application to these technologies, as well as on the protection of individuals with regard to the information that can be derived from their personal data thanks to the use of this tool

Tras la introducción del AI Act, la Ley de IA, se plantean preguntas sobre su relación con el Reglamento General de Protección de Datos (Reglamento 2016/679) y, más en general, sobre el vínculo inextricable e ineludible entre los datos (personales y no personales) y las aplicaciones de inteligencia artificial. Por una parte, la inteligencia artificial, a través del aprendizaje automático, necesita un enorme volumen de datos para aprender y tomar mejores decisiones; por otra parte, la inteligencia artificial permite extraer de los datos inferencias cada vez más recóndita y precisa que luego se incorporan a los flujos de información digital. Las aplicaciones de inteligencia artificial desestabilizan el equilibrio introducido y establecido por las normas del RGPD y plantean dudas sobre su aplicación a estas tecnologías, así como sobre la protección de las personas con respecto a la información que puede deducirse de sus datos personales gracias al uso de esta herramienta
