The Author analyzes the main characteristics and critical issues of the new juvenile re-education program (Article 27-bis of Presidential Decree No. 448 of 1988, intro-duced by law No. 123 of 2023, the so-called ‘Caivano Decree’), taking inspiration from Constitutional Court ruling No. 23 of 2025, which assigned jurisdiction to the preliminary hearing judge, with a collegial nature, and offered an invasive constitu-tionally oriented rewriting of the new instrument of diversion through probation.
