Il significato di 'oportere' in Gai. 3.180

In the face of the vast variety of interpretations suggested for Gai. 3. 180, proving that the question about the foreclosure/extinguishing effect of the formular litis contestatio is still widely open in the doctrine, a new interpretation of Gaius is suggested. This interpretation, concerned to distinguish Gaius’ opinion from that of the veteres, focuses on the expressions “condemnari oportere” and “iudicatum facere oportere” present in the well-known maxim of the republican jurists”.

A fronte della stragrande varietà di interpretazioni suggerite per Gai. 3.180, conferma di come il tema dell’effetto preclusivo-estintivo della litis contestatio formulare costituisca una questione ancora aperta in dottrina, viene offerta una nuova lettura della testimonianza gaiana che, preoccupata di tenere distinto il pensiero del giurista antonino dalla posizione dei veteres, si focalizza sulle espressioni “condemnari oportere” e “iudicatum facere oportere” presenti nella nota massima dei giuristi repubblicani.
