Il ruolo sociale della famiglia nel regime patrimoniale: tra esperienza giuridica romana e normativa vigente

The comprehensive analysis of the evolution of the family in the longest experience of Roman law demonstrates a constant renewal of the patrimonial regime and highlights the difficulties of organizational nature met by the multi-subjective structure of the family from the XIX century so far on the basis of the everlasting alternative between hierarchical inspiration and egalitarian conformation. Correlatively to this, if, on one side, the law-giver is not sensible to the evolution of the social relationship offering a system of the patrimonial relationships among married couples, parents and children based on a no longer existing familiar state of the art; on the other hand, there is incumbent the risk of normative decisions that, not being requested by the current social conditions, would lead to destabilising results, playing as reasons of increasing uncertainties for the population.

La compiuta analisi dell’evoluzione della familia nel corso della plurisecolare esperienza giuridica romana, mentre dimostra come ad essa corrispose contestualmente un costante rinnovamento del relativo regime patrimoniale, per contro mette pure in evidenza le difficoltà organizzative che l’assetto plurisoggettivo della famiglia ha incontrato, a partire dal diciannovesimo secolo fino ai nostri giorni, nella perenne alternativa tra ispirazione gerarchica e conformazione egualitaria. Correlativamente a ciò, se, per un verso, non sempre il legislatore si rivela capace di ‘intercettare’ il cambiamento dei rapporti sociali, offrendo una disciplina dei rapporti patrimoniali, tra coniugi e tra genitori e figli, espressione di una realtà familiare non più esistente; per altro verso, si corre il rischio di interventi normativi non richiesti dalle attuali condizioni della società, che porterebbero ad esiti destabilizzanti, esponendo così i consociati a crescenti incertezze.
