The essay focuses on the theme of the equivalence of protections under Article 11 of Legislative Decree No. 36/2023, in the light of the so-called “correttivo appalti”. The contribution offers an analysis of the main legislative developments concerning the fair treatment of workers in public contracts, as introduced by Legislative Decree no. 209/2024, highlighting both strengths and weaknesses, also through a review of case law and critical reflections on administrative practices. The paper then presents the results of two simulations of the equivalence assessment between national collective labour agreements in the metalworking and non-state assistance subsectors, which help to shed light on critical issues likely to arise in practice.
Il contributo si focalizza sul tema dell’equivalenza delle tutele ex art. 11, d.lgs. n. 36/2023 alla luce del c.d. “correttivo appalti”. Il saggio propone un'analisi delle principali novità legislative in tema di equo trattamento dei lavoratori nei contratti pubblici contenute nel d.lgs. n. 209 del 2024, evidenziane potenzialità e limiti, anche mediante una ricognizione giurisprudenziale e osservazioni critiche sulla prassi amministrativa. Il contributo prosegue illustrando i risultati di due simulazioni del giudizio di equivalenza tra Ccnl nel sottosettore della metalmeccanica e dell’assistenza non statale, che consentono di porre in luce le criticità destinate ad emergere in sede applicativa.
