This essay aims to examine, from a de iure condendo perspective, the possibility for third sector organizations to assume an active role within established systems for the protection of vulnerable adults. To this end, it first outlines models that operationally translate the insights offered by case law on support administration, the international context, and solutions adopted in other jurisdictions. A specific analysis is devoted to the experience of the Austrian Erwachsenenschutzvereine, non-profit organizations institutionally active in the field of adult protection. It then draws some initial conclusions, also in light of established practices in the application of support administration.

Abstract

This essay aims to examine, from a de iure condendo perspective, the possibility for third sector organizations to assume an active role within established systems for the protection of vulnerable adults. To this end, it first outlines models that operationally translate the insights offered by case law on support administration, the international context, and solutions adopted in other jurisdictions. A specific analysis is devoted to the experience of the Austrian Erwachsenenschutzvereine, non-profit organizations institutionally active in the field of adult protection. It then draws some initial conclusions, also in light of established practices in the application of support administration.
